These Terms of Service ("Terms") govern your use of the services provided by MLO Websites Powered by AI ("we," "us," or "our"). By using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Services Overview
MLO Websites Powered by AI provides the following services to mortgage loan officers and related professionals:
- Website Design & Build: Custom website creation for a one-time fee of $450
- Managed Hosting: Ongoing website hosting, security, backups, deployment management, and AI-powered editing, billed monthly according to the selected hosting tier (see Section 3a)
- AI Marketing Tools: Optional AI-generated blog posts, email campaigns, and social media content for $39/month
- Consulting Services: One-on-one human consulting at $95/hour
2. Account and Eligibility
To use our services, you must:
- Be at least 18 years of age
- Provide accurate, complete, and current information
- Be a licensed mortgage loan officer or related professional (or authorized representative thereof)
- Maintain the accuracy of your compliance information, including NMLS ID and licensing details
You are responsible for all activity that occurs under your account and for maintaining the confidentiality of any login credentials.
3. Payment Terms
Website Build
- The website build fee of $450 is a one-time payment due upon invoice
- Work begins after payment is received
- The build fee covers initial design, development, and launch of your website
Monthly Services
- Managed Hosting is billed monthly according to the selected hosting tier (see Section 3a below)
- AI Marketing Tools ($39/month) are billed monthly as a separate add-on
- Billing begins upon website launch for hosting, and upon activation for AI Marketing Tools
- Payments are due on the billing date each month
- Late payments may result in suspension of services after a 7-day grace period
3a. Hosting Tiers & Usage Limits
Client's monthly hosting fee includes the resources and support associated with the selected hosting tier. Hosting tiers are based on normal usage levels for the type of website being hosted and include limits related to bandwidth, data transfer, function execution, build activity, storage, analytics, image optimization, and other third-party platform costs.
Tier 1: Standard Managed Hosting — $49/month
Best for brochure-style websites, local business sites, and normal traffic levels.

- Minor platform maintenance
- Up to 250 GB Fast Data Transfer per month
- Up to 25 GB Fast Origin Transfer per month
- Up to 200 GB-hours function execution per month
- Up to 50 build hours per month
- Includes usage suitable for a small business website
- Does not include abnormal traffic spikes, high-function applications, paid platform add-ons, storage-heavy media delivery, or advanced analytics/features
Tier 2: Growth Hosting — $99/month
Best for sites with growing traffic, frequent updates, more dynamic functionality, or heavier media usage.

- All Standard tier features, plus:
- Up to 500 GB Fast Data Transfer per month
- Up to 50 GB Fast Origin Transfer per month
- Up to 500 GB-hours function execution per month
- Up to 150 build hours per month
- No paid platform add-ons included unless specifically listed
Tier 3: Performance Hosting — $149/month
Best for high-traffic websites, custom application behavior, frequent deployments, or sites that create recurring third-party platform overages.

- Up to 1 TB Fast Data Transfer per month
- Up to 100 GB Fast Origin Transfer per month
- Up to 1,000 GB-hours function execution per month
- Up to 400 build hours per month
- No premium platform add-ons included unless specifically listed
Tier 4: Custom / Enterprise — Custom Quote
Best for clients with large traffic swings, custom application logic, multiple environments, advanced integrations, or usage that requires its own billing configuration. Contact us for a custom quote.
Excluded From All Tiers
Unless specifically included in writing, the following are not included in any hosting tier and will be quoted separately if needed:
- Additional team seats or user accounts on the hosting platform
- Speed Insights, Web Analytics Plus, Observability Plus, or similar premium analytics products
- Blob storage, edge config, KV storage, or other data storage products
- Image optimization beyond standard limits
- Any third-party paid add-on, plugin, or premium service
Hosting Tier Upgrades & Required Upgrades
If Client's website exceeds the included usage for its current hosting tier, or if changes to the website materially increase expected hosting costs, Provider may require Client to move to the next appropriate hosting tier. Provider will give notice of the required upgrade in writing.
If Client does not approve the required upgrade or pay the applicable fees within 7 days of notice, Provider may limit deployments, disable non-essential features, or suspend hosting services in order to prevent unreimbursed third-party costs. Provider is not responsible for downtime, degraded performance, or service interruption caused by Client's refusal to approve a required hosting upgrade.
Consulting Services
- Consulting sessions are billed at $95/hour
- Sessions are billed in 1-hour increments
- Payment is due upon receipt of invoice following the session
4. Website Content and Ownership
Your Content
You retain ownership of all content you provide to us, including text, images, logos, and branding materials. By providing content, you grant us a non-exclusive license to use it for the purpose of building and maintaining your website.
Website Files
You own the content on your website. The website design, code structure, and templates created by us remain our intellectual property but are licensed to you for use with your active hosting subscription. Upon cancellation, we can export your website files for your use.
AI-Generated Content
Content generated by our AI Marketing Tools (blog posts, email campaigns, social media posts) becomes your property once delivered to you. You are free to use, modify, and distribute this content as you see fit.
5. AI-Powered Services
Our services utilize Claude AI technology provided by Anthropic. By using our AI-powered features, you acknowledge that:
- AI-generated content and edits should be reviewed for accuracy before publication
- All AI-generated content — including website copy, blog posts, email campaigns, and social media posts — must be reviewed and approved by your compliance officer or compliance team before publication or distribution
- AI technology, while highly capable, may occasionally produce errors, inaccuracies, or content that does not meet your specific regulatory requirements
- You are ultimately responsible for the accuracy, compliance, and regulatory suitability of all content published on your website or distributed through marketing channels
- We continuously work to improve AI accuracy and reliability, but do not guarantee that AI-generated content will meet all compliance requirements
- AI interactions may be logged for quality improvement and service delivery purposes
6. Compliance Responsibilities & Disclaimer
IMPORTANT: MLO Websites Powered by AI is not a law firm, compliance consultancy, or regulatory authority. We are not compliance attorneys and do not provide legal or compliance advice.
While we follow industry best practices and build websites with mortgage industry compliance standards in mind — including NMLS disclosures, Equal Housing Opportunity notices, and standard regulatory elements — we do not guarantee, warrant, or represent that your website, marketing materials, or any content we produce is fully compliant with all applicable federal, state, and local laws and regulations.
Your Compliance Obligations
- Compliance officer or team approval is required. You must have your compliance officer, compliance team, or legal counsel review and approve all website content, marketing materials, and any changes made to your website — whether made by us, by AI, or by you — before they go live or are distributed
- You are solely responsible for ensuring your website and all associated content meet all applicable federal, state, and local regulations, including but not limited to TILA, RESPA, ECOA, the SAFE Act, CFPB guidelines, and all state-specific mortgage advertising and licensing requirements
- You are responsible for providing accurate and current NMLS ID, licensing, and compliance information
- You must notify us promptly of any changes to your licensing status, compliance requirements, or regulatory obligations
- You are responsible for reviewing all AI-generated content (blog posts, email campaigns, social media posts, and website copy) for compliance before publication or distribution
- You acknowledge that compliance requirements vary by state and jurisdiction, and that we cannot account for all jurisdictional requirements applicable to your specific situation
Limitations of Our Compliance Efforts
- Our use of terms such as "compliant," "NMLS compliant," or "built with compliance in mind" refers to our best-effort application of generally recognized industry practices and is not a guarantee of legal or regulatory compliance
- We make reasonable efforts to stay current with industry compliance standards, but we do not warrant that our knowledge is complete, current, or applicable to your specific regulatory environment
- Compliance requirements change frequently; it is your responsibility to stay informed of current requirements and to ensure your website reflects those changes
- We are not responsible for any compliance failures, regulatory actions, fines, penalties, or legal consequences arising from website content, design, or functionality — regardless of whether such content was created by us, by AI tools, or by you
- No review, approval, or work performed by MLO Websites constitutes compliance approval or legal advice
7. Acceptable Use
You agree not to use our services to:
- Violate any applicable laws, regulations, or industry standards
- Publish false, misleading, or deceptive content
- Infringe on the intellectual property rights of others
- Transmit malware, viruses, or other harmful code
- Engage in spamming or unsolicited communications
- Misrepresent your identity, qualifications, or licensing status
- Use the AI assistant for purposes unrelated to your website management
- Attempt to circumvent security measures or access unauthorized areas
8. Service Level and Uptime
We strive to maintain 99.9% uptime for hosted websites. However:
- We do not guarantee uninterrupted or error-free service
- Scheduled maintenance may require brief periods of downtime, typically during off-peak hours
- We are not liable for downtime caused by factors outside our control, including internet outages, DNS issues, or force majeure events
9. Cancellation and Termination
Cancellation by You
- You may cancel monthly services (hosting, AI Marketing) at any time with 30 days' written notice
- No refunds are provided for partial months or the one-time website build fee
- Upon cancellation, we can export your website files for your use
Termination by Us
- We may suspend or terminate services for violation of these Terms, non-payment, or illegal activity
- We will provide reasonable notice before termination except in cases of serious violations
- In the event of termination, we will make reasonable efforts to provide you with your website files
10. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability for any claim arising from these Terms or our services shall not exceed the total amount you paid us in the 12 months preceding the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for lost profits, lost data, business interruption, or loss of business opportunities
- We are not liable for any regulatory fines, penalties, enforcement actions, license suspensions, compliance failures, or legal consequences arising from the content, design, or functionality of your website or marketing materials — regardless of whether such content was created, suggested, or implemented by us, by AI, or by you
- We are not liable for any damages arising from your failure to have your compliance officer, compliance team, or legal counsel review and approve website content and marketing materials
- We are not liable for changes to regulatory requirements that affect the compliance status of your website after it has been built or modified
11. Indemnification
You agree to indemnify, defend, and hold harmless MLO Websites Powered by AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of our services
- Your violation of these Terms
- Content you provide for or publish on your website
- Your violation of any applicable law or regulation
- Inaccurate compliance information you provide
- Any compliance failure related to your website or marketing materials, including content generated by AI tools
- Your failure to obtain compliance approval from your compliance officer, compliance team, or legal counsel before publishing website content or distributing marketing materials
- Any regulatory action, fine, penalty, or enforcement proceeding related to your website or online presence
12. Intellectual Property
The MLO Websites brand, logo, website templates, proprietary code, and AI integration systems are our intellectual property. You may not copy, reproduce, distribute, or create derivative works from our proprietary materials without our written consent.
13. Third-Party Services
Our services may integrate with or link to third-party services (e.g., domain registrars, CRM systems, analytics platforms). We are not responsible for the terms, privacy practices, or reliability of third-party services. Your use of third-party services is governed by their respective terms.
14. Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through:
- Informal Resolution: We encourage you to contact us first to resolve any concerns informally
- Mediation: If informal resolution fails, disputes shall be submitted to mediation
- Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with applicable rules
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website. Continued use of our services after modifications constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MLO Websites Powered by AI regarding your use of our services and supersede all prior agreements and understandings.
